Stepparent adoption

Adopting your stepchild

If you're raising your spouse's child, adoption makes the tie legal: inheritance, medical decisions, school forms and travel all get simpler. It's one of the shorter adoptions, and often the happiest.

The real work is the other legal parent: whether they consent, whether they can be found, and what the court needs to see if they don't.

Who this is for

  • Your spouse is the child's parent

  • You've helped raise the child

  • The other parent is absent, agrees or objects

  • An adult stepchild may also be adopted

Step by step

How it usually runs

  1. 01

Step 1: Confirm who has to consent

Your spouse, the other legal parent and sometimes the child. I check the rules where you live.

  2. 02

    Step 2: Consent or notice

If the other parent agrees, they sign. If not, I serve notice and explain what a judge will weigh.

  3. 03

Step 3: Any home visit or checks

Some courts want a background check or a brief home visit. I tell you which before you pay for either.

  4. 04

Step 4: The petition goes to court

I prepare and file everything, including a name change for the child if you want one.

  5. 05

    Step 5: Hearing day

A short appearance, usually with the child and your spouse beside you, and the judge's signature on the order.

Four ways it starts

Which one is yours decides how long this takes and what I'll need from you.

  • The other parent agrees

A signed consent and a filing; usually the quickest path.

  • The other parent can't be found

I document the search so a court can proceed without them.

  • The other parent objects

The court asks hard questions here, and I'll be frank about what it needs to hear.

  • The child is old enough to be asked

Many places want an older child's own consent. I prepare them gently.

Stepparent adoption, answered

Does my spouse have to be part of it?

Yes. Your spouse is the child's legal parent and normally signs a consent alongside you. They're also usually at the hearing.

Can the child's last name change?

It can, if you and the child want it. It's a separate request made in the same case.

What happens to the other parent's support obligation?

An adoption by a stepparent generally ends the other parent's rights and duties, support included, which is why courts take consent and notice so seriously.
